Legal Aid is a vital resource for individuals facing Family Law matters who cannot afford a lawyer.  As a family lawyer, I understand the challenges and complexities that arise in childcare disputes, guardianship cases and in domestic violence cases. 

I am committed to helping clients access the justice they deserve, regardless of their financial situation. By providing Legal Aid services, I ensure that everyone has an equal opportunity to protect their rights and interests in Family Law proceedings. 

It is important to understand that Legal Aid is not a free service and may require repayment under specific circumstances. 

If you receive Legal Aid you may be required to repay a portion of the funds provided if you:

  1. Have a successful outcome in your case: if you receive a financial benefit or recover assets as a result of your legal aid funded case. 
  2. Have the means to repay: Legal Aid debt repayment is based on your financial circumstances. 
  3. Fail to disclose changes in your financial situation. It is essential to inform Legal Aid Services if your financial circumstances change during or after your case.

It is important to note that Legal Aid debt repayment is assessed on a case-by-case basis, taking into account individual circumstances. Legal Aid Services will work with you to determine a repayment plan that is fair and manageable based on your financial situation.  answer to this item.


 

In New Zealand, the income threshold for Legal Aid eligibility in family matters is determined by the Legal Services Commissioner. As of 1 July 2023, the income threshold for Family Legal Aid is as follows:

  1. For a single person with no dependent children $27,913
  2. For a single person with one dependent child $44,205
  3. For a single person with two dependent children $63,567
  4. For a single person with three dependent children $72,235 
  5. For a single person with four dependent children $80,719
  6. For a single person with five dependent children $90,235
  7. For a couple with no dependent children $44,205
  8. For a couple with one dependent child $63,567
  9. For a couple with two dependent children $72,235
  10. For a couple with three dependent children $80,719
  11. For a couple with four dependent children $90,235

These figures are subject to change, and it is recommended to visit the office website of the New Zealand Ministry of Justice or contact Legal Aid directly for the most accurate and up to date information on income thresholds for Legal Aid in family matters. 


 

To begin the process, simply complete the Legal Aid form (up until question 25) provide me a summary about your matter.  Additionally, I kindly request that you send me your proof of income, as this will help determine your eligibility for Legal Aid.
